  • Their Own Medical Bills
  • Loss of The Victim’s Future Income

These damages do not include the injuries and suffering their loved one felt, themselves, prior to death. Although the family may not recover, individually, for these injuries, Texas law allows the family to bring a lawsuit on behalf of their loved one to recover these money damages. Through a “Survival” action, the family may bring a lawsuit on behalf of their deceased loved one to recover for the injuries and suffering resulting from his or her death. The family itself collects these damages on behalf of their deceased loved one. These damages are them distributed to the family through administration of the individual’s estate.
